1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and Auto Buffy Inc., a Maryland corporation doing business as AutoBuffy ("AutoBuffy," "Company," "we," "us," or "our").

By accessing or using our website at autobuffy.com (the "Site"), mobile applications, or any products, services, or features we offer (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all other policies referenced herein.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE OUR SERVICES. Your continued use of the Services after any modifications to these Terms constitutes acceptance of the modified Terms.

2. Eligibility and Account Security

To use our Services, you must:

Be at least 18 years of age or the age of legal majority in your jurisdiction
Have the legal capacity to enter into a binding contract
Not be prohibited from using the Services under applicable law
Provide accurate, current, and complete information when creating an account

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account at support@autobuffy.com.

We reserve the right to suspend or terminate your account at our discretion if we suspect unauthorized use, fraudulent activity, or violation of these Terms.

3. Products, Fitment, and Ordering

3.1 Product Information

All products sold through AutoBuffy are new, aftermarket automotive parts that meet or exceed OEM (Original Equipment Manufacturer) specifications. While we strive for accuracy, product descriptions, images, specifications, and pricing are subject to change without notice.

3.2 Vehicle Fitment Verification

IMPORTANT: You are responsible for verifying that products are compatible with your specific vehicle using our Vehicle Fitment Checker before placing an order. Fitment data is compiled from manufacturer and industry sources but may not account for all vehicle variations, modifications, or regional differences. Orders placed without fitment verification may be subject to restocking fees if returned due to incorrect fitment.

3.3 Order Acceptance

Your order constitutes an offer to purchase. We reserve the right to accept or decline any order. An order confirmation email does not constitute acceptance until the order is shipped. We may cancel orders due to pricing errors, product unavailability, suspected fraud, or violation of our policies.

3.4 Pricing and Payment

All prices are in U.S. dollars and do not include applicable taxes, which will be calculated at checkout based on your shipping address. We accept major credit cards, PayPal, Apple Pay, and Google Pay. Payment is due at the time of order. See our Payment Policy for additional details.

4. Shipping, Returns, and Warranty

Our shipping, return, and warranty policies are incorporated into these Terms by reference:

Shipping Policy: We offer free standard shipping on all orders to the continental United States. Orders typically ship within 1-2 business days. See our Shipping Policy for delivery times, carriers, and restrictions.
Return Policy: We accept returns within 30 days of delivery for unused parts in original packaging. Restocking fees may apply. Return shipping costs are the customer's responsibility unless the return is due to our error. See our Return Policy for complete details.
Warranty Policy: All products include a 24-month limited warranty against manufacturing defects. The warranty does not cover labor costs, improper installation, wear and tear, or consequential damages. See our Warranty Policy for claim procedures.

5. Intellectual Property Rights

5.1 Our Intellectual Property

The Site and all content, features, and functionality (including but not limited to all text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the design, selection, and arrangement thereof) are owned by Auto Buffy Inc., its licensors, or other content providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 Trademarks

"AutoBuffy," "Auto Buffy," the AutoBuffy logo, and all related names, logos, product and service names, designs, and slogans are trademarks or service marks of Auto Buffy Inc. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

5.3 Third-Party Trademarks

Vehicle manufacturer names, logos, and vehicle model names displayed on this Site are trademarks of their respective owners and are used solely for identification and compatibility purposes. AutoBuffy is not affiliated with, sponsored by, or endorsed by any vehicle manufacturer. The use of these trademarks does not imply any relationship, sponsorship, or endorsement.

5.4 Limited License

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Services for personal, non-commercial purposes. This license does not include the right to: (a) modify, copy, distribute, or create derivative works; (b) use data mining, robots, or similar data gathering methods; (c) download or copy account information for third-party benefit; (d) frame or use framing techniques; or (e) use meta tags or hidden text.

6. Prohibited Conduct

You agree NOT to engage in any of the following prohibited activities:

Violating any applicable local, state, national, or international law or regulation
Infringing on any intellectual property rights of AutoBuffy or any third party
Transmitting any viruses, malware, worms, or other malicious code
Attempting to gain unauthorized access to our systems, servers, or databases
Interfering with or disrupting the Site or servers/networks connected to the Site
Using any automated system (bots, scrapers, crawlers) to access the Site without permission
Impersonating any person or entity or misrepresenting your affiliation
Collecting or harvesting user information without consent
Engaging in fraudulent activity, including using stolen payment information
Submitting false, misleading, or defamatory content
Harassing, threatening, or intimidating other users or our staff
Attempting to circumvent security features or access restrictions
Using the Site for any commercial purpose without our written consent
Reselling products purchased from AutoBuffy without authorization

We reserve the right to investigate and take appropriate legal action against anyone who violates these prohibitions, including removing content, suspending or terminating accounts, and reporting violations to law enforcement.

7. Technology and Security

7.1 No Unauthorized Access

You may not attempt to probe, scan, or test the vulnerability of our systems or breach any security or authentication measures. You may not access or search the Site by any means other than through our publicly available interfaces.

7.2 Automated Access Restrictions

Automated access to the Site (including through bots, scrapers, or crawlers) is prohibited without our express written permission. Violation of this provision may result in immediate account termination and legal action.

7.3 Reverse Engineering Prohibited

You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software used in connection with the Site or Services.

7.4 Data Security

We implement industry-standard security measures to protect your data. However, you acknowledge that no internet transmission is completely secure. You are responsible for maintaining the security of your devices and account credentials.

8. Disclaimers

THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE; (B) DEFECTS WILL BE CORRECTED; (C) THE SITE OR SERVERS ARE FREE OF VIRUSES OR HARMFUL COMPONENTS; OR (D) THE SITE OR SERVICES WILL MEET YOUR REQUIREMENTS.

AUTOBUFFY DOES NOT PROVIDE AUTOMOTIVE REPAIR ADVICE. PRODUCT INFORMATION IS FOR GENERAL REFERENCE ONLY. CONSULT A QUALIFIED MECHANIC FOR INSTALLATION AND REPAIR DECISIONS. WE ARE NOT RESPONSIBLE FOR IMPROPER INSTALLATION OR MISUSE OF PRODUCTS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AUTO BUFFY INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SUPPLIERS BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, revenue, data, or business opportunities
Any personal injury or property damage arising from your use of products
Any errors or omissions in any content or materials
Any unauthorized access to or use of our servers or your personal information
Any interruption or cessation of transmission to or from the Site
Any bugs, viruses, or similar issues transmitted through the Site
Any vehicle damage, accidents, or injuries resulting from product installation or use

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SITE OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

10. Indemnification

You agree to defend, indemnify, and hold harmless Auto Buffy Inc., its officers, directors, employees, agents, affiliates, licensors, and suppliers from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

Your use of the Site or Services
Your violation of these Terms
Your violation of any third-party rights, including intellectual property rights
Your violation of any applicable law or regulation
Any content you submit or transmit through the Site
Any claims arising from products you purchased and installed
Any fraudulent or unauthorized use of your account

11. Dispute Resolution and Governing Law

11.1 Governing Law

These Terms and any dispute arising out of or related to them or the Services shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law principles.

11.2 Exclusive Jurisdiction

You agree that any legal action or proceeding arising out of or related to these Terms or the Services shall be brought exclusively in the state or federal courts located in Howard County, Maryland. You consent to the personal jurisdiction of such courts and waive any objection to venue.

11.3 Informal Resolution

Before filing any formal legal proceedings, you agree to first contact us at legal@autobuffy.com to attempt informal resolution. We will attempt to resolve your concern within 30 days. If informal resolution is unsuccessful, you may proceed with formal proceedings.

11.4 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS, AND YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

11.5 Time Limitation

Any claim or cause of action arising out of or related to these Terms or the Services must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

12. Copyright Infringement (DMCA)

We respect the intellectual property rights of others. If you believe that any content on our Site infringes your copyright, please send a written notice to our designated agent with the following information:

A physical or electronic signature of the copyright owner or authorized agent
Identification of the copyrighted work claimed to have been infringed
Identification of the infringing material and its location on the Site
Your contact information (address, telephone, email)
A statement that you have a good faith belief that the use is not authorized
A statement under penalty of perjury that the information is accurate and you are authorized to act

13. Termination

We may terminate or suspend your access to the Site and Services immediately, without prior notice or liability, for any reason, including but not limited to:

Abusive behavior toward staff or other users
At our sole discretion for any reason

Upon termination, your right to use the Services will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitation of liability, indemnification, and dispute resolution.

You may terminate your account at any time by contacting support@autobuffy.com. Account termination does not waive any pending obligations or claims.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and other policies incorporated by reference, constitute the entire agreement between you and AutoBuffy regarding your use of the Services and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of AutoBuffy.

14.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government actions, or internet/telecommunications failures.

14.6 Headings

Section headings are for convenience only and do not affect the interpretation of these Terms.

14.7 Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights, except as expressly provided herein.

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

Update the "Last Updated" date at the top of this page
Post the revised Terms on the Site
Notify registered users by email when practicable
Display a prominent notice on the Site for significant changes

Your continued use of the Services after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Services.
